CompuHelp4U LLC Terms and Conditions of Service

 

COMPUTER SERVICE
SCHEDULING

Standard service hours are Monday — Sunday 9 A.M. to 9 P.M., Additional charges may apply for rapid response or service outside of standard hours.

SERVICE JURISDICTION
CompuHelp4U LLC sets the Service Jurisdiction for each city. If a location lies beyond CompuHelp4U LLC standard Service Jurisdiction, additional travel charges may apply. To determine if your location is within a CompuHelp4U LLC standard Service Jurisdiction, inquire at a CompuHelp4U LLC by calling  1-877-222-3319 for information and applicable travel charges.

ADDITIONAL SERVICES
On-site service and must be one of the following: software installation, software service, memory installation, sound/video card installation, network card installation, modem installation, CD/DVD-RW installation, or CD/DVD-ROM installation.

INSTALLATION AUTHORIZATION
For on-site services, a person at least 18 years of age must be present during the entire time period services are provided. If no adult is present when the CompuHelp4U LLC agent arrives, services will be denied and a $60 cancellation charge will be assessed.

RESPONSIBILITY
It is customer responsibility to back up all software and data on your computer's hard drive(s) and/or any other storage devices before the CompuHelp4U LLC agent arrives or performs any work on the computer. CompuHelp4U LLC and/or its third-party service provider and/or agents shall not be responsible at any time for any loss, alteration, or corruption of any software, data, or files.

MINIMUM SYSTEM REQUIREMENTS for wireless home networking only:

At least 10MB free hard disk space and 32 MB RAM on each computer, Operating system and/or ISP passwords must be available, Microsoft Windows 98 SE operating system or later, Operating system discs and key codes must be available, All computers and/or peripherals must be in good working order and spyware free, Broadband services, if any, must be installed and operational before service, including modem connections.

DirecPC™ and DirecWay™ broadband are not covered by CompuHelp4U LLC services.

ACCESS
The CompuHelp4U LLC Agent must have 1) access to your home residence or business and the computer(s) and/or accessories/peripheral(s) to be serviced, 2) your consent and cooperation to enter your home residence or business, 3) a safe working space and work environment, and 4) electrical power must be provided. If the CompuHelp4U LLC Agent determines that these conditions have not been met, services will be denied and a $60 cancellation charge assessed.

SERVICE LIMITATIONS
CompuHelp4U LLC and/or its third-party service providers reserve the right to refrain from providing any or all services ordered and refund the customer's payment, wholly or in part, if minimum system requirements are not met or if technical conditions (such as wiring difficulties or physical barriers) or customer requirements are unusual, extensive, or beyond the scope of this service agreement as reasonably determined by CompuHelp4U LLC and/or its third-party service provider.

FORCE MAJEURE
If CompuHelp4U LLC and/or its third-party service provider's ability to render services is impaired by circumstances beyond the control of CompuHelp4U LLC and/or its third-party service provider, CompuHelp4U LLC and/or its third-party service provider may choose not to provide services.

LIMITATION OF REMEDY
Under no circumstances shall CompuHelp4U LLC and/or its third-party service provider be liable to you or any other person for any damages, including without limitation any indirect, incidental, special or consequential damages, expenses costs, profits, lost savings or earnings, lost or corrupted data, or other liability arising out of or related to the services provided by CompuHelp4U LLC and/or its third-party service provider or out of the installation, de-installation, use of, or inability to use your computer equipment, hardware, peripherals, accessories or the network as a result of the services provided hereunder.

CompuHelp4U LLC shall not be liable for any failure or delay in performance due to any cause beyond its control. If CompuHelp4U LLC ability to render services is impaired by your failure to cooperate or circumstances beyond the control of CompuHelp4U LLC. CompuHelp4U LLC may choose not to provide services. Service can also be denied if dangerous or unhealthy conditions are present including possible code violations. For any un-installation services provided, CompuHelp4U LLC shall not be responsible for repairing any damage or changes made to your residence.

LIMITATION OF LIABILITY & RELEASE
By signing the form on the opposite side of this page, you agree to release and hold harmless  CompuHelp4U LLC, and/or its third-party service provider from and against any loss, liability, or damage, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, profits, lost savings or earnings or liability that you, the owner, or lessee may suffer arising out of, or related to, the services provided by CompuHelp4U LLC. This includes but is not limited to data loss or lack of function in any component or element of your computer system and/or peripherals, any changes or alterations to your residence (for example, changes to walls, baseboards, floors, etc.) as a result of CompuHelp4U LLC and/or its third-party service provider's agents, partners, and/or third-party service providers, regardless of the warranties, disclaimers, and waivers particular service and shall constitute liquidated damages and are a reasonable estimate of damages to you. And considering that under certain circumstances, the work on you computer might require up to 4hrs or more of continue work during the same day at your residence, in which case CompuHelp4U LLC and/or its third-party service provider's agents, partners, and/or third-party service providers will be released and hold harmless from and against any loss, liability, or damage, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, profits, lost savings or earnings or liability that you, the owner, or lessee may suffer arising out of, or related to, the services provided by CompuHelp4U LLC.  Some states do not allow limitations or release of certain damages or liability, so the above limitation of liability and release may not apply to you.

CHANGES, CANCELLATIONS AND REFUNDS
To change your order: You must contact CompuHelp4U LLC at  1-877-222-3319. at least 2.5 hours prior to the scheduled service.

To cancel your order: You must contact CompuHelp4U LLC at 1-877-222-3319.  at least 2.5 hours prior to the scheduled service. If you paid in advance the payment amount will be fully refunded in the manner the purchase was paid.

SERVICE WARRANTY

If you are not satisfied with your service: Call 1-877-222-3319 for find solution to your concern or clarification. We warrant our Service for 7 calendar days from the date the work was completed or shipped. If there is a problem with the service we provided and you notify us within the warranty period, we will reestablish work on your computer as soon as possible to remedy the problem quickly and at no additional cost if your claim is reasonable from CompuHelp4U LLC point of  view, however, for repairs necessitated by a virus or spyware, the service warranty is valid only if the anti-virus and anti-spyware protection for your product is installed and updated during the repair or promptly thereafter (i.e., before you connect again to the Internet). Otherwise respective charge for the new repair, in accordance to our price list will take place. No shipping charges are included and not costs incurred to remove or access the equipment are included.

Prices and terms of payment

(1) If the Contracting Parties have not agreed on a certain price, it shall be calculated according to CompuHelp4U LLC price list, as applicable on the date that the  service order/estimate is signed by customer, plus (if applicable) packaging, transport, transport insurance and tax. The hourly rates, travelling expenses and other incidental expenses shall depend on CompuHelp4U LLC applicable price list.

(2) If nothing else has been agreed in the individual case, the following terms of payment shall apply: all prices are quoted before tax. All invoices, service orders issued by CompuHelp4U LLC shall be due for immediate payment upon completion of the work or notification of ready to ship, without any deductions unless CompuHelp4U has allowed a certain period of time for payment of the invoice. If the customer does not pay the invoice/ service order within 14 days of completion of work or within the period indicated in the invoice/ service order or by the agreed date, the customer shall be in default without a further reminder being required. Consequently default monthly interest shall become payable at a rate of eight per cent of the total amount due. CompuHelp4U reserves the right to claim further damages due to default.

Contractual right of lien. CompuHelp4U LLC shall have a contractual right of lien in respect of the items that come into its possession under this contract in order to secure its claims in respect of the work and services provided. The right of lien shall also extend to claims from earlier work, goods delivered and other work and services in as far as they are connected with the item on which this work was performed.

 Necessary revisions of cost estimates

The customer must provide COMPUHELP4U LLC  with full information regarding all circumstances affecting the realization of the agreements made with COMPUHELP4U LLC . When preparing a cost estimate for the work and services, COMPUHELP4U LLC  shall assume that the information the customer has provided is correct and accurate. If this information should prove to be inaccurate or incomplete, thus involving additional work for COMPUHELP4U LLC, COMPUHELP4U LLC  shall not generally be bound by its quotation/ estimates and shall prepare a new cost estimate or sent invoice according to the additional job performed.

Acceptance of the work and services

The work and services will be considered completed by COMPUHELP4U LLC. When customer signs the invoice, By signing the customer confirms that all work and services performed under the contract have been completed and placed at the customer's disposal and that the contract has been discharged. If partial work and services are agreed, this provision shall apply in the same manner to such partial work and services.
